Dovetails LLC manages both retail and auction services online and at our location in Naples. Our retail division is Dovetails and our auction division is Auctions Neapolitan. Because of this, there are numerous policies governing the use of this site as well as specific policies outlined for services rendered.

Please familiarize yourself with these policies and contact us if you have any questions.

Shipping and insurance costs are always the responsibility of the purchaser.

 

AUCTIONS: All auction purchases are shipped through professional third party shippers. Each shipper must present us with a shipping release from you before we will release your purchase.

To prevent mistakes, the permission note should contain the name you purchased under, address, e-mail and telephone number together with the purchased lot information.

 

We will gladly assist you with shipping arrangements. However, we are not liable for damage or loss in shipment and highly recommend that you pay for insurance coverage on your purchase.

If you prefer to obtain competitive quotes for shipping, below are several companies that have successfully shipped numerous items for our clients. They are each reputable, professional and very familiar with our company. They will make the process easy and as cost effective as possible. You are NOT required to use them and may use any shipping and packaging company you prefer.

With that said, we realize there may be an occasional circumstance that should be an exception. Please read the applicable sections carefully. The policies for returning online store items differs from the policy for returning auction purchases. In all instances, online descriptions are general and may not fully outline condition issues. Please contact us prior to purchase or bidding for a condition report.

Online Store Return Policy:

Items are sold as-is and all sales are final, but we believe in honest representation of the items being sold and stand behind our descriptions. Please view images carefully because they are an integral part of our descriptions. In the event an item is physically materially different than described, we will refund both the purchase price and the shipping costs, provided the purchaser adheres to the following:

  • Send an e-mail to us within 2 business days of receiving the item.
  • Give a brief description of your purchase and the problem.
  • Obtain a confirmation for the return. Return the item to us in the same condition as when sold.
  • Package the item securely and ship insured for the full invoice amount paid.
  • Enclose your name, address and phone number, and copies of our invoice and the return shipping invoice.
  • Provide us with the shipping tracking number.

(Please note that all antique or pre-owned items will have some degree of wear. We encourage you to call us to discuss any particular questions you might have prior to purchasing. Also, color discrepancies are not within our control and will not be considered. Computer monitors can render colors differently, and the color you see on your monitor may not be exact.)

In-Store Return Policy:

When you come to one of our stores to purchase, all antique and resale items are sold as-is and all sales are final. All furniture items are sold as-is and all sales are final. This means No refunds, no returns, no exchanges. However, we have a 24-hour approval system. If you would like to make arrangements for a 24-hour approval, please discuss the terms with a sales representative prior to invoicing.

Chalk Paint® and related products may be returned within 5 business days with original receipt for store credit only and must be unopened and unused.

Retail (brand new) giftware and accessories from our 10the street south, Dovetails Estates & Decor shop may be returned for store credit within 5 business days when accompanied by the original receipt. (Some restrictions may apply.)

 

Auction Terms & Conditions of Sale:

The following is an EXAMPLE of our auction Terms and as a general rule, there is little variation. However, every auction we post has Terms & Conditions specific to that auction. Sometimes the buyer's premium is higher, sometimes there is no buyer's premium at all. Occasionally shipping is offered on smaller, non-complicated lots, other times all shipping is done through third parties. PLEASE BE SURE TO READ THE TERMS & CONDITIONS FOR EACH AUCTION YOU ATTEND.

Example Terms & Conditions of Sale

The following together with or as amended by any posted notices or verbal announcements made during an auction constitutes the entire terms and conditions on which property shall be offered for auction sale by Dovetails LLC doing business as Auctions Neapolitan & Gallery (referred to as "Auctioneer" or "Auction House" ), and any consignor of such property (referred to as "Seller") (collectively referred to as "WE" and/or "US") for whom we act as agent. Auctioneer, Bidder and Seller agree to be bound by these terms for this auction:

1) These terms control our auctions in all regards and supersede all previous announcements, advertisements and published information however distributed, except for any announcement made by Auctioneer during the auction, which will take precedence and be controlling in all instances. Auctioneer has been hired by Seller to act as Seller’s agent in conduction of the auction, and Auctioneer is not serving as an agent for Bidder or any Buyer.

2) Bidder must register with Auctioneer before bidding. Proper identification will be required. Auctioneer reserves the right to refuse to register a prospective bidder for any reason and to require the removal of a person from the auction site for any reason including, but not limited to: (a) tampering with auction lots; (b) any illegal conduct including collusive bidding or stealing; (d) disruptive behavior; (d) failure to abide by these terms; and (d) intoxication. Bidder agrees to leave the auction site immediately and quietly upon request by Auctioneer. Any act of theft, vandalism or disruption will be prosecuted to the fullest extent of the law.

3) Bidder should carefully guard his bidding number to avoid unauthorized purchases for which Bidder will be responsible. A Buyer’s Premium will be in effect for each Auction. This means a surcharge will be added to the amount of the highest bid for each lot to determine the final selling price for that lot. Please be sure to note what the Buyer's Premium is for the auction you are participating in. The percent of Buyer's Premium will be posted with each auction notice.

4) Catalogs and brochures are guides only based on information from sources believed to be reliable, but their accuracy cannot be guaranteed or warranted. Auctioneer will not be liable for any errors or omissions.

5) Auctioneer reserves the right to withdraw any lot, or portion of a lot, from the auction or to cancel the entire auction without notice or liability to Auctioneer or Seller. Auctioneer may also determine minimum acceptable increments to advance the bidding.

6) Each lot will be sold AS IS, WHERE IS with all defects and faults, and no warranties or guarantees of any kind will be given, including no warranty of fitness, merchantability or suitability. Bidders should carefully inspect each lot to determine condition and contents. All measurements are approximate. Bidder acknowledges that all lots were available for inspection prior to the auction and that he relied solely on his own inspection of the lots and not on any information listed in the catalog or otherwise provided by Auctioneer, the auction staff, or Seller.

Note: Certain property sold at auction may be subject to restrictions on its export or resale. For example, restrictions may be imposed under the provisions of the Endangered Species Act of 1973, the Marine Mammal Protection Act of 1972, the Migratory Bird Act of 1982, C.I.T.E.S. (Convention on International Trade in Endangered Species of Wild Fauna and Flora, also known as the Washington Convention) and the conservation laws of the state in which the auction is conducted. In order to export certain items, the potential successful high-bidder should research the relevant regulations to determine if he/she must obtain a special license or licenses. Although licenses can be obtained to export some items that are the subject of these, or other laws, other items may not be exported and some property may not be resold in the United States. (Examples of regulated or prohibited items would be; Ivory, whalebone, tortoiseshell).

Prospective purchasers who intend to export or resell restricted items or items that may be restricted are solely responsible for familiarizing themselves with the laws, rules, customs and regulations regarding export or import of restricted items and for obtaining necessary licenses. Auctions Neapolitan & Gallery can not and does not assure the purchasers that such licenses are or will be obtainable.

7) Limited Return Policy for Online Auction Items:
A buyer may request a return if the physical property materially differs from the information listed, or if the description is, in any material respect, inaccurate.

Shipping costs, duties, tariffs and / or other expenses incurred are non-refundable. At no time shall Auctioneer be liable for more than the fee amount earned from the consignor of the disputed lot if the buyer does not fulfill the requirements stated in these Terms and Conditions of Sale.

8) The highest bidder for a lot recognized by Auctioneer will be the Buyer subject to the satisfaction of any reserve amount for that lot. A lot is sold when the Auctioneer indicates it in customary manner. Bidder agrees, without exception, that if he is the highest bidder for a lot and it is sold to him, an enforceable contract of sale is immediately formed and no further writing of any kind will be required from him to satisfy any decision, principle, rule, statute or other requirement in law or equity.

9) Bidder should assume that all Lots are reserved unless otherwise stated. Auctioneer reserves the right to bid on behalf of consignors up to, but not more than, the pre-established reserve to protect against selling at a price below the reserve. This will be accomplished as necessary by placing successive bids, or bids in response to buyers' bids

10) We accept absentee bids by phone, by mail, via the Internet, in person, or by fax. Absentee bids are requested by no later than two hours before the auction begins. All absentee bidder names and bids are held in strictest confidence, disclosed only in the event of a question after the sale. Absentee bidding is a convenience offered and while we do our best to execute your instructions, we are not liable or responsible for any errors or failure to do so. If you place absentee bids, then choose to attend in person, bid by phone or by any other means, it is solely your responsibility to cancel any or all other bids prior to the start of the auction. The Auction House is not liable or responsible for any errors or failure to do so. Neither seller nor Auctioneer is responsible for a failure to execute absentee or proxy bids caused by human error, or electronic or technical failure of any kind. Should a dispute arise between two or more bidders, the decision of Auctioneer will be final.

11) Ownership, possession and the risk of loss from any cause pass immediately to Buyer when Auctioneer announces the sale of a lot.
a) Buyers are solely responsible for their purchases, and Seller and Auctioneer have no responsibility for lost, stolen or damaged lots.
b) Auctioneers clerking records will be absolute in the event of a dispute.
c) All purchases by those attending the auction must be paid for in within 2 business days of the auction. All puchases by absentee bidders including Internet and telephone bidders must be paid for within 10 business days of the of the auction.
d) A LATE FEE of $10.00 per month plus finance charges of TWO PERCENT (2%) per month (24 PERCENT PER ANNUM) will be charged to Buyer on any balance due beyond 10 business days of the Auction.
e) Acceptable forms of payment include cash, approved check, wire transfer, and accepted charge cards when electronically swiped or imprinted. Charge Cards may be accepted via the internet through PayPal when address can be verified. Auctioneer reserves the right to limit payment method to wire transfer for any purchase over $2,000.00 US unless prior arrangement is made.
f) There will be a $50.00 charge to Buyer for a check dishonored by a bank for any reason.
g) Legal action will be instituted to collect any unpaid account and Buyer agrees to pay all costs of collection, including reasonable attorneys’ fee of THIRTY-THREE AND ONE-THIRD PERCENT (33 1/3%), plus a finance charge of TWO PERCENT (2%) PER MONTH (24 PERCENT PER ANNUM) from the date of the auction until the balance is paid in full.

12) Shipping and Pick Up:
a) Nothing in a lot may be moved from its location prior to being paid for and Buyer must present Auctioneer with a paid receipt.
b) Auctioneer will have no responsibility for loss or damage resulting from Auctioneer’s staff carrying, handling or loading any item(s) for any person.
c) All lots purchased by those attending the auction in person must be removed from the auction site by the end of the auction unless specifically approved by Auctioneer.
d) Arrangements for Shipping of item/s purchased through Absentee bidding must be made within 10 (ten) business days of the auction date.
e) Buyer shall incur STORAGE FEES of $10.00 (ten dollars) per day, per Lot for each Lot not removed within 20 business days of the auction date. Any Lot not removed within 60 days of the auction will be DEEMED ABANDONED and at Auctioneer's sole discretion, may be disposed of in the trash, donated to a charitable organization of Auctioneer's choice, or resold for Auctioneer’s account.
f) Shipping, packaging and insurance are the sole responsibility of the Buyer. Buyer agrees to contact a shipping company, make shipping arrangements and pay shipping and insurance costs directly to the shipping company. The following companies are listed here for convenience, however, Buyer is not required to use them and may make shipping and / or packaging arrangements with any professional shipping company they choose.

13) Florida Sales tax will be added to the purchase price of all taxable purchases. The Sales Tax for Collier County Florida is 6%. Dealers and other exempt organizations must have a current sales tax exemption certificate on file with the cashier prior to invoicing.

14) Persons attending the auction understand that the auction and site may pose both obvious and hidden dangers, defects and other perils and each person assumes the risk of all injury, loss and/or death from any cause whatsoever and Auctioneer and Seller will have no liability whatsoever. Bidder agrees to indemnify Auctioneer and Seller and hold them harmless for any injury, death or other damage to person or property at the auction site which was caused by Bidder. Except for announcements made pursuant to paragraph 1 of these terms, terms may not be amended in any way except by a signed, written agreement between Auctioneer and Bidder.

15) This Agreement will be construed and governed solely in accordance with the laws of the State of Florida and that the exclusive venue for any controversy or claim between them will be in the County of Collier, Florida. Bidder agrees that any controversy or claim arising out of this auction, or any related dealings with Auctioneer or Seller, must be resolved by final and binding arbitration with no appeal permitted except as provided by Florida statute. The parties voluntarily waive their rights to seek traditional remedies in any court including the right to a trial by jury. The prevailing party will be entitled to collect from the other its costs associated with the arbitration, including reasonable attorneys’ fees.

16) Notwithstanding this requirement for binding arbitration, the parties agree Auctioneer and Seller retain their right to pursue a traditional lawsuit against any Buyer for the collection of any payment due them by the Buyer for any purchase at the auction and it is agreed that in that event the defaulting bidder will be responsible for all of Auctioneer’s and/or Seller’s costs of collection including, but not limited to, its attorneys’ fees of THIRTY-THREE AND ONE-THIRD PERCENT (33 1/3%) of any judgment recovered against Buyer.

17) BID RIGGING IS A VERY SERIOUS CRIME AND ANY ILLEGAL CONDUCT BY BIDDER OR OTHERS WILL BE IMMEDIATELY REPORTED BY AUCTIONEER TO THE U.S. ATTORNEY AND DEPARTMENT OF JUSTICE FOR INVESTIGATION AND PROSECUTION TO THE FULLEST EXTENT OF THE LAW. Title 15, Section 1 of the U.S. Code provides any agreement among potential bidders not to bid against one another, or otherwise to dampen the bidding process, is a felony under federal law. The law provides for fines of up to $10 million per violation for a corporate offender and $350,000 per violation for others, as well as imprisonment of up to three years.

18) Registering to bid or attending the auction indicates full understanding and acceptance of these terms along with the agreement to be so bound. If there is anything relevant to the auction or these terms that you do not understand, please ask Auctioneer or a member of Auctioneer’s staff to assist you. We can be reached at 239-262-7333. What information do we collect?

We collect information from you when you register on our site, place an order, subscribe to our newsletter, respond to a survey or fill out a form. When ordering or registering on our site, as appropriate, you may be asked to enter your name, e-mail address, mailing address or phone number. You may, however, visit our site anonymously.

Google, as a third party vendor, uses cookies to serve ads on our site. Google's use of the DART cookie enables it to serve ads to our users based on their visit to our site and other sites on the Internet. Users may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy.

How do we protect your information?

We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information. 
All personal information is transferred through the use of a secure server. Your sensitive/credit information is transmitted directly to PayPal, which uses the most advanced technology to secure your privacy. This may include Secure Socket Layer (SSL) technology and encryption for their Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and they are required to keep the information confidential. We do not access your financial information and your private information (credit cards, social security numbers, financials, etc.) are never stored on our servers.

Do we use cookies?

Yes. (Cookies are small files that a site or its service provider transfers to your computers hard drive through your Web browser (if you allow) that enables the sites or service providers systems to recognize your browser and capture and remember certain information.

We have the right at our sole discretion to remove any content that, we feel in our judgment does not comply with this User Agreement, along with any content that we feel is otherwise offensive, harmful, objectionable, inaccurate, or violates any 3rd party copyrights or trademarks. We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.

h. We do not assume any liability for any content posted by you or any other 3rd party users of our website.  However, any content posted by you using any open communication tools on our website, provided that it doesn't violate or infringe on any 3rd party copyrights or trademarks, becomes the property of Dovetails LLC t.b.a Auctions Neapolitan & Gallery, and as such, gives us a perpetual, irrevocable, worldwide, royalty-free, exclusive license to reproduce, modify, adapt, translate, publish, publicly display and/or distribute as we see fit.  This only refers and applies to content posted via open communication tools as described, and does not refer to information that is provided as part of the registration process, necessary in order to use our Resources.
i. You agree to indemnify and hold harmless Dovetails LLC t.b.a Auctions Neapolitan & Gallery and its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us.

Limitation of Warranties
By using our website, you understand and agree that all Resources we provide are "as is" and "as available".  This means that we do not represent or warrant to you that;
i) the use of our Resources will meet your needs or requirements.
ii) the use of our Resources will be uninterrupted, timely, secure or free from errors
iii) the information obtained by using our Resources will be accurate or reliable, and
iv) any defects in the operation or functionality of any Resources we provide will be repaired or corrected.

Furthermore, you understand and agree that:
v) any content downloaded or otherwise obtained through the use of our Resources is done at your own discretion and risk, and that you are solely responsible for any damage to your computer or other devices for any loss of data that may result from the download of such content.
vi) no information or advice, whether expressed, implied, oral or written, obtained by you from Dovetails LLC t.b.a Auctions Neapolitan & Gallery or through any Resources we provide shall create any warranty, guarantee, or conditions of any kind, except for those expressly outlined in this User Agreement.

Limitation of Liability
